RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

In consideration of being permitted to participate in the training sessions, programs and events (the “Activity”) at @ Fitness, LLC, and Community Project LLC, both an Michigan limited liability company (the “Company”), I represent that I understand the nature of the Activity and that I am qualified, in good health, and in proper physical condition to participate in the Activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the Activity. I, the undersigned, on my behalf, and on behalf of my personal representatives, assigns, and heirs, expressly state as follows:

1. I fully understand that the Activity is inherently dangerous and participation or other involvement in the Activity may involve risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my own actions, or inaction, those of other participants in the event, the conditions in which the Activity takes place, negligence, intentional act, accident, act of God, or otherwise; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the Activity.
2. I expressly release, waive and discharge the Company and its respective directors, officers, administrators, agents, employees, representatives, organizers, affiliates, volunteers, umpires, referees, successors and assigns, as well as the sponsors, donors and supporters of the Company (collectively, the “Releasees”) from all liability for any and all claims, demands, losses, or damages (including attorneys’ fees) incurred by me arising out of or related to the Activity, whether caused by me or some other person, and whether caused by negligence, intentional act, accident, act of God, or otherwise.

I have carefully read this RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT. I fully understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in the full force and effect.

If the participant is under the age of 18, a parent or legal guardian must read and sign this RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT. I, the participant’s parent and/or legal guardian, understand the nature of the Activity and the participant’sexperience and capabilities and believe the participant to be qualified to participate in the Activity. I hereby agree to release all Releasees from all liability for any and all claims, demands, losses, or damages (including attorneys’ fees) incurred by the participant and me arising out of or related to the Activity, whether caused bythe participant, me or some other person, and whether caused by negligence, intentional act, accident, act of God, or otherwise.
